Terms of Use

Last updated: 10 October 2026

The short version

These Terms are the agreement between you and us about playing Nandonia. Signing in means you accept them. We have written them in plain language because a rule you cannot understand is not much of a rule.

The four things most worth knowing. Gold and everything else in the game is a licence to use it inside Nandonia, not property you own, and it has no real-world value and cannot be cashed out. Gold is delivered the moment you pay, so sales are final apart from the situations set out below. This is a live game and things will change, break, and sometimes be rebalanced under you. And if we ever had to close the game, unspent Gold would not be refundable as cash, which is section 13 and is worth reading before you buy.

There are limits on what we can be held responsible for, and you agree to cover us if someone sues us over something you did. Those are sections 15 and 16. They are real limits and we are not going to hide them in the middle of a paragraph.

None of that touches your consumer rights. Australian Consumer Law guarantees cannot be excluded by any contract, including this one, and if you live in the EU or the UK your own mandatory protections still apply. Section 17 says so, and it overrides sections 6, 14, 15 and 16, along with the liability-excluding parts of sections 12 and 21, wherever they disagree.

1. The agreement

Nandonia is operated by a sole trader based in Western Australia, Australia. We run the browser game at nandonia.com. In these Terms, "we" and "us" mean that operator, and "you" means you, the player.

These Terms apply whenever you use Nandonia. You accept them by signing in. There is no tick box to click: the notice under the sign-in buttons tells you that signing in means accepting these Terms and our Privacy Policy, and that is how the agreement is made.

Two other documents form part of this agreement. The Community Guidelines, at nandonia.com/community-guidelines, set the standard for anything you write in the game. The Privacy Policy, at nandonia.com/privacy, explains what we collect and what we do with it. If you have not read them, section 7 and the Privacy Policy are the two worth your time.

If you do not agree to these Terms, the answer is simply not to sign in. There is no part of Nandonia you can use without accepting them.

2. Who can play

  • You must be at least 13 years old to have a Nandonia account.
  • If you are under 16, you need a parent's or guardian's permission before you sign up.
  • If you are under 18, you need a parent's or guardian's consent before you spend any money, every time. That is not a one-off permission granted at sign-up.

By signing in you are telling us you meet these requirements. We do not have a way to verify anyone's age, and we are not going to pretend we do. What we can do is act on what we learn: if we find out an account belongs to someone under 13, we will delete it and its data.

If you are a parent or guardian and your child has an account or has made a purchase you did not agree to, email us at [email protected]. Tell us the display name or the email address on the account. We will look into it, we will delete the account if you ask, and a purchase made by a child without a parent's consent is exactly the kind of thing section 6 says we will consider refunding.

You also must not be someone we have previously banned, and you must not be barred from using a service like this under the law that applies where you live.

3. Your account

You sign in with a Google account, an Apple account, or a Solana wallet. One Nandonia account uses one sign-in method, and we do not link them together. If you lose access to the account or the wallet you signed in with, you lose access to your Nandonia account, because that sign-in is the only proof we have that the account is yours.

Keeping that sign-in secure is your job. Anything done through your account is treated as done by you. If you signed in with a wallet, guard the private key: we never hold it, we cannot recover it, and anyone who can sign with it can be you as far as our servers are concerned.

One person, one account. Do not create additional accounts to get around a limit, a cooldown, or a penalty, and do not run several accounts that help each other.

Your account is personal to you. You may not sell it, rent it, share it, give it away, or transfer it to anyone else, and you may not buy one from anyone else.

If you think someone else has got into your account, email us at [email protected] as soon as you can.

4. Your licence to play

While you keep to these Terms, we give you permission to play Nandonia. That permission is:

  • Personal to you, and not transferable to anyone else.
  • Limited to playing the game for your own enjoyment, not for a business.
  • Non-exclusive, meaning everyone else gets the same permission.
  • Revocable, meaning it can end. Section 10 covers ending it for a breach, section 18 covers ending it in the ordinary way.

That permission is all you get. You are not buying the game, a copy of it, or any share of it, and nothing in these Terms gives you ownership of any part of Nandonia.

5. Gold, diamonds and other virtual items

This is the section people skip and later wish they had not, so it comes before the one about buying things.

Gold, diamonds, cosmetics, lands, buildings, envoys and every other virtual item in Nandonia are a licence to use them inside the game. They are not property, you do not own them, and they are not a credit balance we hold for you. They exist as a number in our database and they exist only while the game does.

None of it has any real-world value. Gold and virtual items cannot be cashed out, withdrawn, redeemed, or exchanged for money, cryptocurrency, or anything else of value outside Nandonia. Buying Gold is buying the use of it in the game, in the same way that buying a cinema ticket is buying the film rather than a share of the cinema. It is not an investment, a deposit, or a store of value, and you should not treat it as one.

Gold does move between players in one specific place: the in-game diamond market, where one player lists diamonds for a Gold price and another player pays it. That is a transfer inside the game between two accounts, and we burn a small fee on the sale, meaning it is destroyed rather than paid to us. It is not a cash-out and it does not give Gold a real-world price. Trading Gold, diamonds, items, or accounts for real money outside the game is not allowed, and section 9 covers that.

We may change, rebalance, devalue, restrict or discontinue any virtual item, at any time, without compensating you. That includes changing what Gold buys, what a building or an envoy skill does, how much anything costs, and how quickly anything is produced. This is a live game and balancing it is the ordinary business of running it. If a change removes something you paid for outright, rather than adjusting how it performs, tell us and we will look at it.

Worth knowing, because it affects how you should think about Gold: no gameplay mechanic produces Gold. It comes from buying it, from a small number of one-off achievements, and from the daily login reward. Nothing you build or do in the world generates more of it.

6. Buying Gold, and refunds

How payment works

Gold is sold in packs. You can pay by card through Stripe, which collects your card details on its own hosted page so they never reach us, or with SolanaPay, which takes SOL or USDC from a wallet you control. Those are the only two ways to pay.

How a pack is priced depends on how you pay, so please check the amount before you confirm. Card payments through Stripe and SolanaPay payments in USDC are priced in US dollars. Paying in SOL works differently: each pack has its own SOL price that we set, and that price is not a live conversion of the dollar price and does not move with the SOL exchange rate. The two can therefore be worth quite different amounts. Your wallet shows you the exact quantity of SOL before you sign, and that quantity is the price you are agreeing to pay. Separately from all of this, your bank, card issuer or wallet may add its own conversion or network fees, which are between you and them.

SolanaPay is a payment on a public blockchain. Those transactions are final and irreversible by design: once it is confirmed, nobody, including us, can reverse it. If you want the option of your payment provider stepping in on your behalf, pay by card.

Immediate delivery, and what that costs you

Gold is credited to your account as soon as the payment is confirmed. You ask for it immediately and you get it immediately, and you agree to that when you buy.

This matters if you live in the EU or the UK. Consumer law there normally gives you 14 days to change your mind about something bought online. That right does not apply to digital content you asked to be delivered straight away, once delivery has started. By buying Gold you are asking us to deliver it immediately and you acknowledge that you lose that 14-day right of withdrawal. We are spelling this out rather than burying it, because it is a real right you are giving up.

Refunds

Because Gold arrives instantly and can be spent instantly, all sales are final. We do not offer refunds for change of mind, for Gold you have already spent, for a game change you dislike, or because your account was closed for breaking these Terms.

Three things that sentence does not touch:

  • Your consumer guarantees. Section 17 overrides this whole section wherever they conflict, and they cannot be signed away.
  • Duplicate or erroneous charges. If you were charged twice, charged for a pack you did not buy, or charged and never received the Gold, email us and we will sort it out. That is not a favour, it is us fixing our own mistake.
  • A purchase made by a child without a parent's consent. Contact us and we will consider it, as section 2 says.

Beyond those, we may still choose to give a refund in a situation we think deserves it. Doing that once does not commit us to doing it again. If we do refund a purchase, we remove the Gold it bought from your account, up to whatever is left of your balance. You do not keep both.

Chargebacks

If something is wrong with a payment, please email [email protected] first. We are one person and we will usually have it fixed faster than a bank dispute would.

If you raise a chargeback or a payment dispute instead, we may suspend or close the account while it is resolved, and we may remove the Gold that payment bought. Repeatedly buying Gold, spending it, and then charging it back is fraud, and we will treat it that way.

So that you can tell which rule applies to your balance: for a single chargeback made in good faith, we take back the Gold that particular payment bought and nothing more, and the rest of your balance is untouched. The wider forfeiture in section 10, which covers everything on the account, is for the serious cases named there, including a pattern of chargeback abuse. One disputed payment is not that.

7. The Community Guidelines

Our Community Guidelines are at nandonia.com/community-guidelines. They form part of these Terms, so breaking them is breaking these Terms, and section 10 applies.

They are the practical version of the rules: what you can call a city or an envoy, what you can write in the world, how to treat other players, what counts as fair play, and what happens when a name is rejected. They are shorter and more useful than this document, and they are written for a player rather than a lawyer.

The one thing to carry over from them: the content standard is all ages. Everything you write should be fine in a game a child is playing. That is deliberately stricter than the 13 year old account minimum in section 2, because a name you choose is seen by everyone, not only by people your own age.

8. What you write

This covers everything you put into the game: your display name, city and envoy names, diary fragments, scholar's notes, inscriptions, custom lore choices, and the reasons you give when you report another player.

You keep ownership of what you write. We do not claim it. What you give us is permission to run the game with it in: a non-exclusive, worldwide, royalty-free licence to store it, display it to other players where the game is designed to show it, back it up, and moderate it. That permission lasts as long as the content is in the game, and it exists so we can operate Nandonia rather than so we can do anything else with your writing. We do not use it in advertising.

By submitting something you are confirming it is yours to submit, that it does not infringe anyone else's rights, and that it meets the Community Guidelines.

We can moderate. Everything you write passes an automatic filter first, which rejects a clear breach outright. Written submissions then go into a queue and a person reads every one of them before it appears in the game, not only the ones the filter flagged. Names go live immediately and are reviewed if the filter or another player raises them. We may reject a submission, remove content, or reset a name that breaks the Guidelines. Moderation is a judgement call and we will sometimes get it wrong in both directions. A name reset is not an accusation, and the Guidelines explain how to appeal one.

We keep the original wording of anything you submit, including text that was rejected and text you later changed, so that moderation decisions can be reviewed and appeals can be handled. The Privacy Policy says the same thing.

One practical warning. Names and in-world writing are visible to other players by design, and other players may quote or screenshot them. Do not put anything in them that would harm you if it were public.

9. Things you must not do

Playing the game unfairly

  • Cheating, or using any tool, modification or trick to get an advantage the game does not give you.
  • Exploiting a bug instead of reporting it. Finding one is not a problem and we would rather hear about it. Farming one once you know it is a bug is.
  • Using bots, scripts, macros or any kind of automation to play for you.
  • Running multiple accounts to get around limits or penalties, or to feed one account from another.
  • Buying, selling, renting or transferring accounts, Gold, diamonds or items for real money or anything else of value outside the game.

Treating people badly

  • Anything the Community Guidelines prohibit, in any name or text you submit.
  • Harassing, threatening, or targeting another player.
  • Pretending to be another player, or to be Nandonia staff.
  • Deliberately working around the name filter, by misspelling, spacing out, or substituting characters in something you know would be blocked.
  • Filing false reports about other players.

Interfering with the service

  • Attacking, overloading or probing our servers, or trying to get into any part of the system you are not meant to reach.
  • Scraping the site or hammering our API beyond normal play, or getting around rate limits.
  • Reverse engineering, decompiling, or trying to extract the source of the game, except where the law says you may despite this clause.
  • Copying, reselling or building a competing service out of the game's content or data.
  • Using Nandonia for anything unlawful, or to advertise anything.

If you find a security problem, please report it to [email protected] rather than exploiting it or posting it publicly. We will not take action against anyone who reports a genuine issue in good faith.

We do look for this. Automation in particular leaves patterns in how an account behaves that ordinary play does not, and we watch for them. Section 10 sets out what we do when we find something.

10. What happens if you break the rules

We try to match the response to what actually happened. Roughly in order of severity, we may:

  • Send you a message explaining what the problem is.
  • Reject a submission, or remove content that breaks the Guidelines.
  • Reset a name, so you are asked to choose a new one. This is the most common thing we do, and it is deliberately the mildest: you pick another name and carry on.
  • Reverse an unfair advantage, such as gains from a bug or from cheating.
  • Limit what an account earns from the game, for a period. This is aimed at breaches that work by accumulating more than fair play allows, and it is the proportionate answer to those: you keep the account and every feature in it, and what changes is the rate at which unfair gains accrue.
  • Restrict your access to particular features.
  • Suspend the account for a period.
  • Close the account permanently.

We will normally start at the lowest step that fits, but we do not have to work through them in order. Something serious, such as fraud, an attack on the service, or content that puts someone at risk, can go straight to the account being closed.

We pick the step we reasonably consider proportionate to what happened, on the evidence we have. Some breaches do not show up as one event we can point to. Automation looks like a pattern across days rather than any single action, and an account being shared or sold looks like a change in how it is used rather than an announcement. Where we reasonably believe evidence of that kind shows a breach, we may act on it, and we keep the measure to what the evidence actually supports.

A measure runs for a limited period and is renewed only while it is still warranted. We review it regularly rather than setting it and forgetting it. If what caused it is still happening, it carries on. If it has stopped, the measure is not renewed and lapses by itself shortly afterwards. So a measure will not outlive the behaviour that caused it by more than a short period, and it will not run on indefinitely without being looked at.

If we close an account for a serious breach, any unspent Gold and every virtual item on it are forfeited and are not refunded. We would only do that where the breach was serious, such as fraud, chargeback abuse, or cheating that affected other players. We would not close an account in good standing just to take its Gold.

A measure that limits what an account earns never touches Gold you have bought or what that Gold buys you. If you paid for something, you get it, whatever else is happening with the account. The one exception is an account closed for a serious breach, which the paragraph above covers.

If we apply any of this to your account, we will tell you that we have and what rule it relates to. What we will not always do is explain how we detected the problem, or set out exactly how a measure works, because publishing that is how it gets worked around by the next person. That limit covers our methods. It is never a reason for us to refuse to read your appeal, and it does not narrow anything in section 17.

You can appeal any of this. Email [email protected], tell us what happened, and a person will read it. We make mistakes, the automatic name filter certainly does, and we would rather hear about it than have you assume it was deliberate.

11. Our intellectual property

The game itself belongs to us. That covers the code, the artwork, the maps, the music and sound, the interface, the lore and the writing, and the Nandonia name and logo. Section 4 gives you permission to play, and nothing more than that.

So do not copy or redistribute the game's assets, do not use our name or branding in a way that suggests we are involved with or endorse something we are not, and do not build another product out of our content.

The friendly part, so nobody has to ask. Screenshots of your own game, videos, streams, guides, wikis, fan art and reviews are all fine, and we like them. Just make it clear they are yours rather than ours, and do not charge people for access to our assets themselves.

If you think something in Nandonia infringes your copyright, email [email protected] with enough detail to identify the work and where it appears, and we will look into it.

12. Third party services

Nandonia relies on other companies and networks to work: Google and Apple for signing in, Stripe for card payments, the Solana network for SolanaPay, Cloudflare for delivering traffic, Sentry for error reporting, and Google Cloud Storage for database backups. The Privacy Policy lists them all and says what each one receives.

Each of them has its own terms and privacy policy, which govern your relationship with them. We do not control those services, and, as far as the law allows and subject to section 17, we are not responsible for them: if Google sign-in is down, or a card payment is declined, or the Solana network is congested, that is not something we can fix from here.

Wallets and blockchains are worth calling out separately. We never hold your private key and we can never move funds from your wallet. Anything you do with your own wallet, including approving a SolanaPay transaction, is yours to check before you confirm it. Transactions on a public blockchain are permanent and publicly visible.

If we ever link to another site from the game, the same applies: we do not control it and linking is not an endorsement.

13. Availability and what happens if we shut down

Nandonia is provided as it is. It is run by one person, not by a company with an operations team. There will be bugs, downtime, maintenance, lost progress after a rollback, and changes you did not ask for. We do not promise the game will be available at any particular time, or that any of it will keep working the way it does today.

We may change how the game works, add features, remove features, rebalance anything, or suspend the service for maintenance. Where a change is significant we will try to give notice in the game first, but for something urgent, such as a security fix or an exploit being used, we will act first and explain afterwards.

If we shut the game down

We may stop running Nandonia. It might not attract enough players to be worth running, or it might stop being financially possible for one person to keep going. We would rather tell you that now than have you find out from a holding page.

If we decide to close the game permanently, this is what we commit to:

  • We will announce it at least 30 days before the game closes, in the game and on the website.
  • We will stop selling Gold the moment we announce it, so nobody buys Gold into a game that is closing.
  • During that period you can keep playing and spending whatever Gold you have.

When the game closes, your account, your game, your virtual items and any unspent Gold end with it. Unspent Gold will not be refunded as cash, converted, or transferred anywhere, because as section 5 explains, Gold was never money we were holding for you. It was permission to use something inside a game, and when the game stops the permission has nothing left to apply to. We are not able to pay out balances on shutdown and we are not going to imply otherwise.

The practical advice that follows from that: buy Gold to spend on things you want now, not to stockpile. A large unspent balance is the one position where a shutdown would cost you real money.

Two limits on the above. If we were forced to stop suddenly, for legal or financial reasons outside our control, we might not be able to give 30 days notice, and we are not going to promise something we could not deliver. And section 17 still applies: nothing here removes a consumer guarantee, so if a shutdown meant we failed to supply something you had already paid for and not received, your rights under that section are unaffected.

14. Disclaimers

Read this section together with section 17, which overrides it wherever the two disagree. Nothing here removes a right you have that the law does not let us remove.

Subject to that, Nandonia is provided as it is and as it is available, without warranties of any kind. In particular we do not promise that:

  • The game will be uninterrupted, timely, secure or error free.
  • Bugs will be fixed, or fixed within any particular time.
  • Your game progress or data will never be lost or corrupted, although we do take daily backups.
  • The game will suit any particular purpose you have in mind for it.
  • Anything another player says or does in the game is accurate, fair, or anything to do with us.

Nandonia is entertainment. It is not gambling, an investment, a financial product, or a way to make money, and nothing in it should be treated as financial advice.

15. Limitation of liability

Read this section together with section 17, which overrides it wherever the two disagree. Everything below applies only as far as the law allows.

First, what we do not limit at all. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not permit us to limit.

The cap

For everything else, our total liability to you, for all claims added together, is capped at the greater of these two amounts:

  • 100 Australian dollars, or
  • the total amount you actually paid us in the 12 months before the event you are claiming about.

If you paid in another currency, we work out what it was worth in Australian dollars. For an ordinary currency such as US dollars we use the Reserve Bank of Australia's published daily exchange rate for the day you paid. For a payment in SOL or USDC, which has no single daily rate, we use the value at the moment the transaction was confirmed on the blockchain. If you have never paid us anything, the cap is the 100 dollar figure.

Knock-on losses

We are not liable for indirect or consequential loss. In plain terms, that means the losses that follow on from a problem rather than the problem itself: lost profits, lost business or opportunity, lost time, loss of goodwill, or the value you place on an account or on the hours you have put into it. We are also not liable for the loss of game progress, or of virtual items you earned or were awarded in play, which section 5 explains have no real-world value.

That last exclusion does not extend to virtual items you actually paid real money for. If we lose Gold you bought, or something you bought with it, that is a claim you can bring, and the cap above already limits it to what you paid us. Excluding it on top of the cap would take away a real remedy for almost no benefit to us, and it would sit badly next to our promise in section 6 to put right a payment where the Gold never arrived.

Why this section exists, since you are entitled to know. Nandonia is run by one person as a sole trader, so there is no company standing between a claim and that person's own savings and home. A free game that can generate unlimited liability is a game that cannot be offered at all. The cap is what makes it possible to run this, and it is set against what the game actually costs a player rather than against what a claim might be worth.

16. Indemnity

Read this section together with section 17, which overrides it wherever the two disagree.

"Indemnify" means one thing: if somebody else brings a claim against us because of something you did, you cover our costs of dealing with it rather than us carrying them. That includes the claim itself, any damages or settlement, and reasonable legal costs.

It applies where the claim arises from:

  • You breaking these Terms or the Community Guidelines.
  • Something you submitted to the game, including a name or any writing, for example if it infringed someone's copyright or defamed them.
  • Your conduct towards another player.
  • Anything you did through the game that broke the law or someone else's rights.

Now the limits on it, which matter as much as the clause itself and which we would want if the positions were reversed:

  • It does not apply to any part of a claim caused by our own breach of these Terms, our own negligence, or our own wrongdoing.
  • It does not apply to the extent the loss could reasonably have been avoided by us, for example by us taking an obvious step to reduce it.
  • We will tell you promptly if a claim comes in that we expect you to cover, and we will give you the details we have.
  • We will not settle such a claim without asking you first, and we will not settle it in a way that admits fault on your behalf without your agreement.
  • You may take over the defence of the claim yourself, at your own cost, using lawyers you are happy with, as long as you keep us informed.

This is not a way for us to pass on the ordinary costs of running a game. It is there for the case where a player does something that drags an uninvolved operator into someone else's dispute.

17. Consumer law comes first

This section overrides sections 6, 14, 15 and 16, by their headings: "6. Buying Gold, and refunds", "14. Disclaimers", "15. Limitation of liability" and "16. Indemnity". It also overrides any other provision of these Terms that limits or excludes our liability or your remedies, wherever it appears, including the parts of sections 12 and 21 that do so. Wherever any of those is inconsistent with this section, this section wins and the other is read as being cut back only as far as necessary to make it lawful.

That is not politeness. Some consumer rights cannot be excluded by any contract, and a term that tries to exclude them is not merely unenforceable: writing it can itself break the law. So we would rather state clearly which of our own clauses give way.

If you are in Australia

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

In plain language: if we sell you something and fail to deliver it, or the service is not fit for what it is sold as, "all sales are final" does not apply and neither does the cap in section 15, to the extent the law says so.

If you are in the EU or the UK

Your own consumer protections apply too, and nothing in these Terms removes them. That includes your rights when digital content is faulty or is not what was described. The one right that is genuinely affected is the 14-day withdrawal right, and only because you asked for immediate delivery, which section 6 explains.

Everywhere else

If the law where you live gives you a right that a contract cannot take away, you keep it, and the sections above are read as being limited to whatever the law does allow. Nothing in these Terms is intended to mislead you about the rights you have.

18. Ending the agreement

You can stop playing at any time, for any reason, and you do not need to tell us. If you also want your account and its data deleted, email us and we will do it. There is no self-serve delete button: a person reads your email and does the work. The Privacy Policy explains that process and the 30 day timeframe.

Deleting your account removes your game. Lands, cities, envoys, achievements and any unspent Gold go with it, and none of it can be restored afterwards.

We can end this agreement, or close or suspend your account, if:

  • You break these Terms or the Community Guidelines, as section 10 sets out.
  • We are required to by law.
  • It is necessary to protect other players or the service itself.
  • We stop running the game, as section 13 sets out.

Outside those cases we will not close an account that is in good standing without giving you reasonable notice first, so that you can spend what you have and get a copy of anything you want to keep.

Some sections are written to survive the end of this agreement, because they would be meaningless otherwise: 5 on virtual items, 8 on the licence you gave us for content still in the game, 11 on our intellectual property, 14, 15, 16 and 17, 20 on governing law, and this sentence.

19. Changes to these Terms

Nandonia is in active development, so these Terms will change as the game does. The "last updated" date at the top of this page always tells you which version you are reading.

For a small correction or clarification we will simply update the page. If we make a change that materially affects your rights, such as changing the refund position, the liability cap, or what happens to Gold, we will give you notice in the game before it takes effect.

If you do not accept a change, your remedy is to stop playing and, if you want, to ask us to delete your account. Continuing to play after a change takes effect means the updated Terms apply to you. We do not currently keep a record of which version each player has read, and we say so rather than implying an acceptance trail that does not exist.

Be clear about what leaving costs you, because it is the same answer as section 13 and you should not have to work it out yourself. Unspent Gold is not refunded when you leave. If you stop playing, your balance simply sits in the account unused, and if you ask us to delete the account it goes with everything else, as section 18 says. So if a change is one you cannot live with, spend your balance before you ask us to close the account. We would rather tell you that than let a balance quietly disappear.

A change will never apply backwards to something that already happened before it took effect.

20. Governing law

These Terms, and any dispute arising out of them or out of playing Nandonia, are governed by the law of Western Australia, Australia.

You and we agree that the courts of Western Australia have exclusive jurisdiction over any such dispute.

That is subject to one important exception. If you are a consumer living somewhere else, nothing in this section takes away any mandatory protection given to you by the law of your own country, and it does not remove any right you have under that law to bring a claim in your local courts or to have your local law applied. Where your own country's law says a clause like this cannot bind you, it does not bind you.

Before anyone goes near a court, please email [email protected]. Almost everything is quicker to sort out directly, and we would genuinely rather hear about a problem than read about it in a letter.

21. General

  • The whole agreement. These Terms, the Community Guidelines and the Privacy Policy are the whole agreement between you and us about Nandonia. They replace anything said earlier about it.
  • If one part fails. If a court decides some part of these Terms cannot be enforced, that part is cut back only as far as needed, or removed if it cannot be, and everything else carries on.
  • Not enforcing something is not giving it up. If we do not act on a breach straight away, we can still act on it later, and we have not given up the right to act on the next one.
  • Transferring the agreement. You cannot transfer your rights under these Terms to anyone else. We may transfer ours if Nandonia is sold or handed to another operator, and we would tell players before that happened. Your rights would not be reduced by it.
  • Nobody else can rely on this. These Terms are between you and us. They do not give rights to anyone who is not a party to them.
  • Things outside anyone's control. As far as the law allows and subject to section 17, we are not responsible for failures caused by events we cannot control, such as a hosting or network outage, a payment provider failing, or a natural disaster.
  • Headings. The section headings are there to help you find things, and do not change what the sections mean.
